
In an official letter to mullah Jalal-adin Saqir, The International Committee of Jurists in Defense of Ashraf (ICJDA) warned him that denying Geneva Conventions and the rights of Ashraf residents and mendacity and distortion regarding that the PMOI is doing terrorist activities is amounting to preparing the grounds for a human tragedy and war crimes against the protected persons and as such, these statements warrant legal pursuit by international courts.

Dear Mr Saqir,
I am writing on behalf of the lawyers for the residents of Camp
Ashraf, members of the People’s Mojahedin Organisation of Iran
(PMOI), and representing 8,500 European jurists who support the
rights of the members of the PMOI.
International Committee of Jurists in Defence of Ashraf (ICJDA) carefully examined your extremely provocative remarks in Friday prayer, 20 June 2008, in Baratha Mosque, regarding the residents of Ashraf Camp, broadcast by Al-Iraqiya Television.
In your remarks, you have denied the Fourth Geneva Convention as well as the Ashraf residents’ right to asylum which has been mentioned in Article 7 of the Resolution adopted by the European Parliament, 12 July 2007. You have also made allegations against members of People’s Mojahedin Organisation of Iran, charging them with having committed crimes in Kirkuk and Basra where they have never been present. Further, you have falsely claimed that they receive 4,000 government rations, which belong to the people of Diyala province. Your remarks about the residents of Ashraf carrying weapons, training and arming terrorists in their camp as well as carrying out terrorist attacks are also obvious and sheer lies.
By such remarks you clearly prepare the grounds for a human catastrophe. The ICJDA considers these remarks to be a clear violation of the principle of non- refoulement, International Humanitarian Law, International Law and conventions, particularly the Common Article three of the Geneva Conventions. The ICJAD views your remarks as amounting to preparing the grounds for the perpetration of war crimes and terrorist attacks against the protected persons residents of Ashraf. As such, these statements warrant legal pursuit by international courts. Therefore it is absolutely necessary that you publicly disavow any direct or indirect role in such atrocities were they to occur.
Despite what you have called for, International Law and public positions by the United Nations High Commissioner for refugees and the International Committee of Red Cross, have in no uncertain terms impressed upon the Multi-National Force- Iraq as well as officials of the Iraqi government, their obligations to act in accordance with the principle of non refoulement concerning the members of the people’s Mojahedin Organisation of Iran in Camp Ashraf, and of the prohibition on the transfer of the responsibility of their protection from Multi-National Force- Iraq to any other country or authority in violation of the principle of non-refoulement.
