Foreign commission of Italian Parliament obligates Italian government to fully respect verdict issued by European Court of First Instance in de-listing PMOI

Following declarations issued by the majorities of Italian Parliament and Senate in support of Iranian Resistance, the foreign commission of Italian Parliament ratified a resolution reaffirming that the procedure adopted in issuing the rulings by the British courts and the European Court of First Instance obligate the Italian government to “the necessity of full respect for the verdict issued by the European Court of First Instance”.
The resolution notes the verdicts by the European Court of First instance on 12 December 2006 which annulled the decision adopted by the Council of Ministers on 21 December 2005, and the verdicts issued by the British courts in removing the PMOI from the list of proscribed organizations. The resolution goes to add, “On 23 June 2008, both Houses of UK passed a resolution unanimously that annulled the designation of the PMOI as a terrorist organization, and on 24 June, the British Home Secretary officially removed the PMOI from the British list of proscribed organization.
“In support of removing the PMOI from the European list of terrorist organizations, many senators and the MPs from the ‘Majority’ and the ‘Opposition’ as well as over half of the members of Parliament signed statements with the same purport”, added the resolution.
The resolution continues, “On 14 June 2007, the foreign committee of the Parliament ratified the resolution No. 7-00196 regarding the EU’s list about the individuals and the organizations involved in the terrorist acts in which obligates the government to support the full respect for the verdict of European Court of First instance on 12 Dec 2006 in the EU’s Council of Ministers’ session.
In its final part, the resolution emphasizing that the PMOI residing in Ashraf are “under the protection of Multi National Force headed by the U.S. based on the Fourth Geneva Convention” commits the Italian government to guarantee the International laws and conventions and the principle of non-refoulement, and also to “fully respect the verdict issued by the European Court of First Instance” that annuls the decision adopted by the Council of Ministers against the PMOI.
